The facts in the case are not in dispute. The plaintiffs-appellees are all residents and taxpayers of Rush county. They complain that the board of county commissioners contemplate action which is in violation of certain statutes and which would result in the imposition of an illegal tax upon them. Plaintiffs brought this action under the authority of K.S.A. 60-907.
